State Government Approval (SGA)


WHO SHOULD APPLY


Under Industrial Coordination Act, 1975, manufacturing companies with shareholder fund RM2.5 million and above or employing 75 or more are required to obtain a Federal Manufacturing License (FML) from the Ministry of International Trade and Industry, Malaysia (MITI).

In Sabah, manufacturers with shareholders fund of less than RM2.5 million or engaging less than 75 employees are required to obtain the State Government Approval (SGA) from the Department of Industrial Development & Research (DIDR).


PROCESSING OF SGA APPLICATION

  1. Applicants for SGA are required to submit applications via SGA Application On-Line  click here to SGA Application Online

  2. Applications are tabled at the Industrial Coordination Commitee (ICC) meeting held once a month.

  3. The SGA would be issued by DIDR upon recommendation of the ICC and endorsement by the Permanent Secretary, Ministry of Industrial Development (MID).

FACTORY IN OERATION ONLINE REGISTRATION (FIOR) SYSTEM

Registration is for factories currently in operation that does not have Manufacturing License / Approval.

Applicants are required to register via FIOR system   click here to SGA Application Online

FAST TRACK APPROVAL

Approval of Fast Track will be given with the following provisions:

Approval of Fast Track which has met four (4) basic requirements will be granted only to the application for Federal Manufacturing License (FML) [will not include the application for State Approval (SGA)]. The four (4) basic requirements are as follow:
 

  1. Non-sensitive industries;

  2. The location is sited in the existing industrial area that is compatible with the surrounding land uses;

  3. Not subject to approval for Environmental Impact Assessment (EIA); and

  4. Products promoted by the Government.


FML applications eligible for approval of Fast Track to be referred to the Permanent Secretary, Ministry of Industrial Development as Chairman of the ICC for approval. Approval of Fast Track will be submitted to the Malaysian Investment Development Authority (MIDA) within 7 working days from receipt of the application form subject to the information provided is complete. Applications that have been approved for Fast Track will be reported at the ICC's meeting and to the Minister of Industrial Development for information only. To overcome delays, applications that were supported by the ICC only requires the confirmation of the Permanent Secretary, Ministry of Industrial Development (without endorsement from the Minister of Industrial Development).

NO OBJECTION LETTER (NOL)

ICC approval is required before NOL is issued to FML/Incentive application.

To obtain the NOL, applicant is required to submit/send in the copy of the MIDA's interim approval to DIDR for the department to issue the NOL (to be signed by Director).
